- How O.J. Simpson Will Beat the RAP
- By David Stager
- Detective, Rohnert Park Dept of Public Safety (California)

-
- With the high level of crime everywhere, it is no longer enough for the
- police to just prove the criminal did it. Before your case ever gets
- into court -- before a District Attorney will even file your case -- the
- increasing courtroom trend is that the police must also disprove any
- conceivable "bullshit" story the criminal (or the criminal's attorney)
- might concoct in court.
-
- By applying standard and accepted "bullshit" courtroom defense techniques
- to bear on the O.J. Simpson case, here's the story any typical street
- criminal, or any halfway decent criminal defense attorney will probably
- offer up in court:
-
-
-
-
- The prosecution has rested. O.J. takes the witness stand and says:
-
- "Yes, I was stalking Nicole and her boyfriend. Yes, I was very jealous
- and angry. I was following her around, driving my Bronco, and wearing my
- driving gloves and stocking cap. I don't want people to recognize me in
- public, so I sometimes wear the cap. All of a sudden, I saw 'some guy'
- come out of the bushes and it looked like he was going to rob them.
-
- "I knew I had to do something to help, but by the time I ran across the
- street it was too late. He'd slashed their throats! I tried to grab him
- and we wrestled around. I guess that's when one of my gloves came off and
- the stocking cap got ripped off my head. Then he started slashing at me
- and he cut my finger with a knife, but I got in a good punch on the guy
- and he ran off.
-
- "I went over to Nicole and her boyfriend and I guess I touched them. All I
- was doing was checking to see if I could do CPR or something to save them,
- but they were dead and there was blood all over the place. I was scared.
- I knew everyone would blame me because of my history, and how could I explain
- why I was there without telling the police I was following her? I knew it
- would look bad.
-
- "Yes, I washed the blood off my car, that's true. Like I said, I was scared.
- But I didn't do it! Yes, I lied to the police at first. But I was right!
- The police did try to blame me! But it was really this other guy! I knew
- I didn't do it, so I knew the police couldn't prove I did it. Yeah, I hopped
- the back fence and I guess I dropped the other glove with the mixture of
- blood from Nicole and her boyfriend on it, but like I said, I touched them
- both to see if I could do CPR.
-
- "After I got a lawyer, he told me not to say anything so I couldn't tell
- the police the truth later when I realized the police were going to blame
- me anyway. But I'm telling the truth now! I didn't do it! You've got to
- believe me!
-
- "I've got a problem with obsession -- I admit it. I still loved her and
- I was following her -- but I didn't kill her! I didn't want to admit my
- problems and tell the world that I was a stalker. But I was. I've got a
- problem, but I know now that what I did was a mistake. I shouldn't have
- lied, but I lied because of my problem, I couldn't admit a mistake, but
- I'm not a murderer! I was there, but it wasn't me that killed them!
- Because I lied the real killer is going to get away. I'll have to bear
- that burden all my life. It was selfish and stupid. I'm so sorry."

-
- With all the money, lawyers, jury consultants, media hype, celebrity
- worship, and O.J.'s general acting skills and likability, a simple
- street-level "bullshit" story is all it's going to take for O.J. to
- beat the rap. It happens all the time in every courtroom every day.
- O.J. will walk.
